Introduction

Welcome to Biashara Bora POS. These Terms and Conditions govern your access to and use of our website, mobile application, and POS services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these terms, you must not use our Services.

1. User Responsibilities

• You must be at least 18 years old or have legal guardian consent to use our Services.
• You agree to provide accurate, current, and complete information during registration and keep it updated.
• You are responsible for all activities that occur under your account.
• You must not use the Services for any illegal purpose or in violation of any applicable law.
• You agree not to interfere with or disrupt the Services or servers/networks connected to the Services.
• You must not attempt to gain unauthorized access to any part of the Services.

2. Account Security

• You are solely responsible for maintaining the confidentiality of your account credentials.
• Do not share your password or access credentials with any third party.
• You must notify us immediately at biasharaboraofficials@gmail.com if you suspect any unauthorized use of your account or any other breach of security.
• We will not be liable for any loss or damage arising from your failure to comply with this section.

3. Payments & Transactions

• All fees and charges for paid Services are quoted in Tanzanian Shillings (TZS) unless otherwise stated.
• Payments must be made through the authorized payment methods displayed on our platform.
• You are responsible for paying all applicable taxes associated with your use of the Services.
• Refunds, if any, are subject to our Refund Policy and are granted solely at our discretion.
• We reserve the right to suspend or terminate access to paid features for non-payment.

4. Intellectual Property

All content included in the Services — text, graphics, logos, icons, images, software, audio, video, and the compilation thereof — is the exclusive property of Biashara Bora or its licensors and is protected by Tanzania and international copyright, trademark, and other intellectual property laws.

• You may not copy, reproduce, modify, distribute, display, perform, or create derivative works from any part of the Services without our express written permission.
• You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal or internal business purposes only.

5. Limitation of Liability

To the fullest extent permitted by law, Biashara Bora, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Services
• Unauthorized access to or alteration of your transmissions or data
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• The transmission of any bugs, viruses, trojan horses, or the like

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim.

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last updated” date.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

7. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts located in Arusha or Dar es Salaam, Tanzania.
